The signing of the 2007 UN Declaration of the Rights of Indigenous Peoples by over a hundred states is a realization of the importance of the quest of indigenous peoples to direct their present and future existence, together with the knowledge and heritage they have acquired from their ancestors which they constantly mould to survive and thrive in a contemporary world made up of competing interests that are often at odds with their physical, cultural, and spiritual survival. The paper examines (...) some of the interconnected philosophical and legal issues concerning indigenous knowledge and the indigenes' quest to safeguard their knowledge, with indigenous philosophical views given the necessary focus in analyzing these issues. It also traces how these philosophical views inform and are reflected in international documents, including the 2007 UN Declaration of the Rights of Indigenous Peoples. (shrink)

We review current theoretical cosmology, including fundamental and mathematical cosmology and physical cosmology (as well as cosmology in the quantum realm), with an emphasis on open questions.

Research has demonstrated that employee reactions to monitoring systems depend on both the characteristics of the monitoring system and how it is implemented. However, little is known about the role individual differences may play in this process. This study proposes that individuals have generalized attitudes toward organizational control and monitoring activities. We examined this argument by assessing the relationship between employees’ baseline attitudes toward a set of monitoring and control techniques that span the employment relationship. We further explore the effects (...) of employees’ generalized attitudes toward monitoring and their individual ethical orientations on their attitudinal reactions to an Internet monitoring system implemented in their workplace. Results of a longitudinal study indicate that as expected, prior beliefs and ethical orientation interact to affect employees’ reactions to monitoring systems. In recent years, the practices of work organizations have raised increasing concerns regarding individual privacy at work. It is clear that people expect and value privacy in their personal lives. However, the extent to which privacy perceptions influence individuals’ work attitudes is less clear. Research has explored the extent to which employee perceptions of privacy derive from characteristics of the programs themselves. However, there is a paucity of research that examines how the characteristics of the individual employee may influence perceptions (...) of these programs. In this study we seek to shed light on this issue, as we examine how the individual ethical orientation of employees influences perceptions of a variety of human resource programs that have the potential to be perceived as invasive. Results indicate that ethical orientation exerts direct effects on perceived invasiveness of programs and exerts both direct and indirect effects on perceived appropriateness of programs. Implications for research and for managers adopting privacy-related programs are discussed. (shrink)

Dr Noel Semple, Professor Russell Pearce and Professor Renee Knake combine to compare legal profession regulation in the US with that of the countries closest to it institutionally and culturally: Canada, Australia, New Zealand, the United Kingdom and Ireland. This enables them to develop an illuminating taxonomy of legal professional regulation, and to describe the assumptions and objectives underlying the different approaches to regulation. The US and Canada provide a 'professionalist-independent framework' that centres on 'a unified, hegemonic occupation of (...) lawyer' which promotes self-regulation, and the exclusion of non-lawyers from partnership and investment in law practices. By contrast, in other countries that they examine, 'consumerist-competitive approaches' predominate, opening up the profession to co-regulation with executive government and allowing for different forms of legal occupations and non-lawyer influence and investment in law practices. Of course, as they show, in some countries there are combinations and hybrids of these two approaches. Unlike Rhode, who endorses England and Wales' consumerist-competitive approach to regulation in the Legal Services Act 2007, Semple, Pearce and Knake consciously avoid stating a preference for one approach over the other. Purpose This paper aims to explore the technologization of peace work through “remote support monitors” that use social and digital media technologies like social media to alert local violence prevention actors to potentially violent situations during demonstrations. Design/methodology/approach Using a distributed cognition lens, the authors explore the information processing of monitors within peace organizations. The authors adopt a qualitative thematic analysis methodology composed of interviews with monitors and documents from their shared communication and discussion channels. The authors’ analysis seeks to (...) highlight how information is transformed between social and technical actors through the process of monitoring. Findings The authors’ analysis identifies that the technologization of monitoring for violence prevention to assist nonviolent activists produces two principal and related forms of transformation: appropriation and hidden attributes. Monitors “appropriate” information from sources to fit new ends and modes of representation throughout the process of detection, verification and dissemination. The verification and dissemination processes likewise render latent supporting informational elements, hiding the aggregative nature of information flow in monitoring. The authors connect the ideas of appropriation and hidden attributes to broader discourses in surveillance and trust that challenge monitoring and its place in peace work going forward. Originality/value To the best of the authors’ knowledge, this study is the first to focus on the communicative and information processes of remote support monitors. The authors demonstrate that adoption of social and digital media information of incipient violence and response processes for its mitigation suggests both a social and technical precarity for the role of monitoring. Processing and recognizing facial expressions are key factors in human social interaction. Past research suggests that individuals with autism spectrum disorder present difficulties to decode facial expressions. Those difficulties are notably attributed to altered strategies in the visual scanning of expressive faces. Numerous studies have demonstrated the multiple benefits of exposure to pet dogs and service dogs on the interaction skills and psychosocial development of children with ASD. However, no study has investigated if those benefits also extend to the processing (...) of facial expressions. The aim of this study was to investigate if having a service dog had an influence on facial expression processing skills of children with ASD. Two groups of 15 children with ASD, with and without a service dog, were compared using a facial expression recognition computer task while their ocular movements were measured using an eye-tracker. While the two groups did not differ in their accuracy and reaction time, results highlighted that children with ASD owning a service dog directed less attention toward areas that were not relevant to facial expression processing. They also displayed a more differentiated scanning of relevant facial features according to the displayed emotion. Results from the present study suggest that having a service dog and interacting with it on a daily basis may promote the development of specific visual exploration strategies for the processing of human faces. This article is aimed at introducing a French discourse analysis model, e.g. the ‘star model’, initiated by the LAA team led by Robert Vion in Aix-en-Provence, to English-speaking researchers. It will be argued that language activity is multi-dimensional and can be traced at various heterogeneous levels of speech productions belonging to macro as well as micro orders. Speakers achieve different varieties of positioning which result in negotiating an interactional space within a pre-given situation. The model is precisely designed to offer (...) a unified and comprehensive view of such heterogeneous phenomena in constant interconnection. In this study, we also intend to illustrate our approach through the analysis of two different corpora. Speakers’ strategies under extreme conditions will be analysed; the various sequences used were taken from a special corpus which we were asked to study as part of a national research programme. In order to illustrate interactional space shifts, we will also use the transcript of a meeting which took place between a patient and a medical investigator in a hospital in Marseilles. (shrink)

Phonological Knowledge addresses central questions in the foundations of phonology and locates them within their larger linguistic and philosophical context. Phonology is a discipline grounded in observable facts, but like any discipline it rests on conceptual assumptions. This book investigates the nature, status, and acquisition of phonological knowledge: it enquires into the conceptual and empirical foundations of phonology, and considers the relation of phonology to the theory of language and other capacities of mind. Despite pervasive variation in the content of laws, legal theorists and anthropologists have argued that laws share certain abstract features and even speculated that law may be a human universal. In the present report, we evaluate this thesis through an experiment administered in 11 different countries. Are there cross‐cultural principles of law? In a between‐subjects design, participants (N = 3,054) were asked whether there could be laws that violate certain procedural principles (e.g., laws applied retrospectively or unintelligible laws), and also (...) whether there are any such laws. Confirming our preregistered prediction, people reported that such laws cannot exist, but also (paradoxically) that there are such laws. These results document cross‐culturally and –linguistically robust beliefs about the concept of law which defy people's grasp of how legal systems function in practice. (shrink)

This event-related potential (ERP) study examined the impact of phonological variation resulting from a vowel merger on phoneme perception. The perception of the /e/–/ε/ contrast which does not exist in Southern French-speaking regions, and which is in the process of merging in Northern French-speaking regions, was compared to the /ø/–/y/ contrast, which is stable in all French-speaking regions. French-speaking participants from Switzerland for whom the /e/–/ε/ contrast is preserved, but who are exposed to different regional variants, had to perform a (...) same-different task. They first heard four phonemically identical but acoustically different syllables (e.g., /be/–/be/–/be/–/be/), and then heard the test syllable which was either phonemically identical to (/be/) or phonemically different from (/bε/) the preceding context stimuli. The results showed that the unstable /e/–/ε/ contrast only induced a mismatch negativity (MMN), whereas the /ø/–/y/ contrast elicited both a MMN and electrophysiological differences on the P200. These findings were in line with the behavioral results in which responses were slower and more error-prone in the /e/–/ε/ deviant condition than in the /ø/–/y/ deviant condition. Together these findings suggest that the regional variability in the speech input to which listeners are exposed affects the perception of speech sounds in their own accent. (shrink)

The study of historiography is undergoing a revolution akin to that which took place in the history of political thought in the 1960s, and the work of J.G.A. Pocock is central to both. Pocock's continuing exploration, in Barbarism and Religion (1999-), of the intellectual contexts of Gibbon's History of the Decline and Fall of the Roman Empire, is central to this enterprise, and this essay situates the origins of his own work within a pre-‘Cambridge School’ Cambridge and its experience of (...) what might be called the Butterfieldian moment. That was marked by a desire to treat religion seriously as a driving force in history; and the same concern is applied here to further understanding an eighteenth-century controversy in which history and religion were dramatically involved, and which profoundly affected Gibbon's own historical and religious views. The work of Conyers Middleton and John Jortin is critically examined from this perspective. These preludes to Gibbon lead to a series of postludes examining the particular contexts in which Victorian and twentieth-century historians and writers, from Henry Hart Milman to Evelyn Waugh, variously appreciated and interpreted Gibbon. The whole is to be seen as a reflexive engagement with Pocock's vitally illuminating studies in eighteenth-century historiography. ☆ A slightly revised version of a lecture given at the University of Sussex on 22nd May 2008, on the occasion of a colloquium devoted to J.G.A. Pocock's Barbarism and Religion. The editing of the correspondence of major figures in intellectual history is an essential scholarly activity. Yet in this country in recent years it has neither been the priority it should be, nor has it received the support that it deserves. Of course there have been exceptions to this, perhaps notably – for the early modern period – the epic one-man effort of Esmond de Beer in his later years in producing The Correspondence of John Locke (though this regrettably, and (...) frustratingly, lacks a composite index). A further exception, the edition of The Correspondence of Henry Oldenburg by A. R. and M. B. Hall, was unfortunately flawed by the need to change publishers midway in the series, which has led to a marked disparity in the availability of the latter part of the set compared with its early volumes. In any case, like the Locke edition, this was conceived in the heady days of the 1960s and early 1970s, and few have ventured such enterprises since. Virtually the only exception is Noel Malcolm's edition of the manageable-sized Correspondence of Thomas Hobbes (two volumes, 1994). Moreover, it is revealing of the acute need to justify the publication of such material felt by editors and publishers alike that the promotional leaflet for this edition went so far as to claim that it was ‘one of the most important scholarly publications of the twentieth century’ – a claim that is the more ironic in view of the quite significant shortcomings in its method of presenting the material that it contains. This article presents evidence supporting the claim that ethical reasoning is a skill that can be taught and assessed. We propose a working definition of ethical reasoning as 1) the ability to identify, analyze, and weigh moral aspects of a particular situation, and 2) to make decisions that are informed and warranted by the moral investigation. The evidence consists of a description of an ethical reasoning education program—Ethical Reasoning in Action —designed to increase ethical reasoning skills in a variety of (...) situations and areas of life. ERiA is housed at a public, major comprehensive U.S. university—James Madison University—and assessment of the program focuses on interventions delivered prior to and during orientation for incoming first-year students. Findings indicate that the interventions measurably enhance the ability of undergraduate students to reason ethically. ERiA’s competency-targeted program and positive student learning outcomes offers a promising model for higher education ethics programs seeking to connect classroom learning in ethics to decision-making in everyday life. (Oxford: Clarendon Press, 1994), lxxxv, 1008p.The literature on Hobbes in English and other European languages has grown so large in the past two decades that it has become almost unmanageable by students of the philosopher. No one (...) who is interested in Hobbes, however, can afford to overlook the two books that are reviewed here, the first, Quentin Skinner’s study of the relationship of Hobbes to rhetoric, and the second, Noel Malcolm’s edition of Hobbes’s correspondence.Skinner is well known not only as a leading British Hobbes scholar and historian of early modern political thought but likewise for his ideas concerning the correct method of studying the history of political philosophy. In a view akin to R. G. Collingwood’s he maintains that there are no permanent or perennial questions in political philosophy and that a historical approach based on a thorough comprehension of context is the only way to grasp what political philosophers are doing and saying when they write their texts. In implementing this prescription, he argues that to understand a historical text it is necessary to reconstruct its author’s intentions and the meaning of his ideas by ascertaining the linguistic conventions and usages and the intellectual currents and back-ground that form its context. He offers the present study both as an exem-plification of this method and as a new interpretation of the principles of Hobbes’s political philosophy which takes rhetoric as its focal theme. His aim, he tells us, is to situate Hobbes’s theory and practice of civil science within its intellectual context and to depict the philosopher less as the author of a philosophical system than as a contributor to a series of debates about the moral sciences within Renaissance culture. Our judgment of the success of his work will accordingly depend on whether or not we are satisfied that rhetoric possessed for Hobbes and his philosophy the crucial significance that Skinner claims for it [End Page 361].In recent years a number of scholars have discussed Hobbes’s attitude to rhetoric, and there have been at least two books on the subject. 1 Commensurate, however, with its ambitious goal of proffering a new interpretation of Hobbes’s work on politics, Skinner’s treatment of his involvement with rhetoric is much richer and far more learned than preceding studies. By rhetoric most people nowadays mean no more than a writer’s literary strategy, but this is not what Skinner intends by the term.
